These Terms govern your use of aigrowthify.com and any services provided by Adset Digital Marketing, a sole proprietorship based in Pune, Maharashtra, India, trading as AI Growthify ("we", "us"). By using the website, booking a call, or buying a service, you ("Client", "you") agree to these Terms.
1. Our services
We provide done-for-you marketing and automation services for businesses, including websites, CRM and pipeline setup, AI voice receptionists, AI chat, lead follow-up, review requests, customer-list reactivation, advertising management and SEO content. Our services are delivered on third-party platforms, primarily HighLevel (LeadConnector). Exact scope, price and deliverables are set out in your proposal, invoice or order ("Order"). If an Order conflicts with these Terms, the Order wins.
2. Plans, fees and payment
• Prices are in US dollars (USD). Plans and prices may change for new clients; your price is locked for your current term. Current plans are shown on our Services & Pricing page. • Setup fees are invoiced before work begins. Monthly fees are billed in advance each month from your start date. • Payment is due on receipt of invoice by card or bank transfer through our payment providers. • Booked-Jobs Engine: $1,500 setup + $1,500/month. Billed monthly. Cancel any time with 30 days' written notice. The setup fee is not refundable once setup has started. • Founding Client 6-Month Pass: $6,000 for 6 months, paid in two parts ($3,000 at signup and $3,000 on day 45). No setup fee. Limited to our first 5 clients. After month 6, continues at $1,000/month unless cancelled with 30 days' notice. • Starter plan: $299/month with a 6-month minimum term. If cancelled before month 6, the remaining months of the minimum term are due. After month 6, cancel any time with 30 days' notice. • Market Domination Partner: $3,000 setup + $3,000/month. Billed monthly. Cancel any time with 30 days' written notice. The setup fee is not refundable once setup has started. • AI calling and texting usage is billed at cost. Ad spend paid to Google or Meta is separate and billed at cost. • Third-party costs are separate unless your Order says they are included, for example: advertising spend, domain registration, carrier registration fees (A2P 10DLC), and unusual phone/AI usage beyond normal limits. • If a payment fails, we may pause services after 7 days' notice until the balance is paid. • Founding-client pricing stays locked for as long as the subscription stays active without a break.
3. Your responsibilities
• Give us accurate business information (services, prices, hours, service area, booking rules) and timely access to accounts we need (domain, Google Business Profile, calendars, phone forwarding). • Review and approve AI scripts, website copy and automations before launch. You are responsible for the accuracy of business information you provide. • Hold the rights to any logos, images, content and customer lists you give us. • Messaging compliance: you confirm that every contact you ask us to call, text or email has given the consent required by law (including the US Telephone Consumer Protection Act (TCPA), CAN-SPAM Act and carrier rules), and that you will honor opt-out requests. You must complete A2P 10DLC carrier registration under your own business details to send business texts in the US. • Use our services lawfully and not for spam, harassment, misleading claims or any prohibited content.
4. AI services: important limits
AI receptionists and chat assistants work within the information and rules you provide. They can occasionally misunderstand a caller or make a mistake. They are not a substitute for emergency services, and they do not give legal, medical, financial or safety advice. You remain responsible for your business decisions and for reviewing call summaries and bookings. Calls and chats handled by our AI may be recorded and transcribed; you are responsible for any call-recording notices your state or country requires for your customers.
5. Results
We work to improve your lead response, bookings and reviews, but we do not guarantee specific numbers of calls, leads, jobs, revenue, reviews or search rankings, except for the specific written guarantees in our Refund & Cancellation Policy.
6. Third-party platforms
Our services rely on third-party platforms (such as HighLevel, phone carriers, Google, Meta and AI model providers). We are not responsible for their outages, policy changes, price changes, account suspensions or carrier filtering, but we will help you resolve issues where we can.
7. Intellectual property
• Content you provide remains yours. • Once all fees are paid, you own the final website copy and design content created specifically for you, and your customer data. • We keep ownership of our templates, snapshots, scripts, prompts, workflows, know-how and tools, and grant you a licence to use them while your subscription is active. Our automation systems run inside our platform account and are not transferred when you cancel, but we will export your contacts and website content on request.
8. Confidentiality
Each party will keep the other's non-public business information confidential and use it only to perform under these Terms.
9. Term and termination
• You may cancel any monthly plan with 30 days' written notice to support@aigrowthify.com, except the Starter plan's 6-month minimum and the Founding Client 6-Month Pass. • We may suspend or end services immediately if you breach these Terms, fail to pay, or use the services unlawfully. • On termination, unpaid fees become due. We will provide an export of your contacts and website content within 14 days on request.
10. Limitation of liability
To the maximum extent allowed by law: our total liability for any claim is limited to the fees you paid us in the 3 months before the claim arose; and we are not liable for indirect or consequential losses, including lost profits, lost jobs or lost data. Nothing limits liability that cannot legally be limited.
11. Indemnity
You agree to cover us against claims arising from your content, your customer lists, your instructions, or your breach of messaging and consent laws.
12. Governing law and disputes
These Terms are governed by the laws of India. We will first try to resolve any dispute in good faith by email. If unresolved within 30 days, the courts at Pune, Maharashtra, India have exclusive jurisdiction.
13. General
We may update these Terms; changes apply from the date posted. If any part is found to be unenforceable, the rest remains in effect. These Terms and your Order are the entire agreement between us.
